Version 2011.11.12

 

Articles 26.4a and 26.4b are modified to include the expression at birth, fx. "A child is automatically granted citizenship at birth...".

Article 21.7 is modified to include civil defence and social services. It reads now:

"Every citizen of 18 years of age or older shall be conscripted to service for 12 months in Defence Forces, Civil Defence or Social Services. It is an obligation of every conscript to serve according to the best of one's ability."

Article 9.5j is removed because it was a repitition of 9.6e.

 

Article 28.4 is moved from Section 28 Federal Sovereignty to Section 33 Foreign Relations. It is now article 33.2.

Article 10.3 is modified for adding the expressions grandparents and grandchildren and or other forms of family. The article reads now:

"Persons in close kinship are spouses, cohabitants, partners, parents and children, grandparents and grandchildren, siblings, cousins, nephews, nieces, aunts, uncles, in-laws, and other relatives by marriage, partnership, cohabitation or other forms of family."

Article 8.17f is modified for adding the expression unfair trial. The article reads now:

"The extradition will not result in death penalty, torture, physical or psychological harm, or cruel, inhuman or degrading treatment of the person, or unfair trial."

Grammatic improvements.

 

Article 23.11 about board of directors of economic enterprises is rewritten for improving the power balance between administrative councils and enterprises.

The maximum number of terms for any delegate in the same council is reduced from 4 to 3 for referendum councils in article 14.5 and administrative councils in article 15.5.

 

The word food in article 23.17a is replaced by basic food.

In articles 14.20, 15.20 and 18.14 the expression
No one with criminal conviction or ongoing court hearing
is replaced by
No one with criminal record.

 

The article on right to personal property is moved from Section 23 Economy to Section 8 Civil Rights (now article 8.13). This has been done for placing this article in a more relevant section and for providing it with better protection by deeper entrenchment inherent to the first 10 sections of the constitution.

 

Article 10.3 Persons in close kinship is split in two: 10.3 and 10.4.

In article 6.7b the words all companies are replaced by enterprises.

 

Article 7.10 is added for defining religious groups.

 

Article 7.12c is added for making an exception for medical reasons.

Although the lottery method for election of delegates already had a positive effect for increasing the chance of rotation, additional requirements limiting the number of terms are introduced for referendum councils in article 14.5 and administrative councils in article 15.5.

 

In article 23.10, requirements limiting the number of enterprises for any director (member of board of directors) are introduced.

In section 27 Language, the article 27.3 is split into two articles, 27.3 and 27.4.

The expression cultural and ethnic groups is added in articles 14.6c and 15.6c. These articles read now:

"One-third of the delegates shall be elected from functional, social and cultural communities within the jurisdiction of that council, e.g. cultural and ethnic groups, workplaces, student organizations, labour unions, consumer and other organizations."

 

Version 2011.03.23

 

The word belief is added in articles 4.2, 10.1, 11.2 and 26.1. The first part of article 4.2 reads now:

"Equality means equal rights, responsibilities, obligations, conditions and opportunities for all human beings regardless of race, colour, ethnicity, gender, sexuality, belief, culture, language, political or other opinion, national or social origin, birth, property or status."

The second part of article 21.9 is removed, as it was essentially repeating 21.2, and because two distinctly different parts were compiled in one article. The shorter article 21.9 reads now:

"It is prohibited for Defence Forces to engage in unlawful activities, unprovoked aggression, occupation or colonization."

Article 18.14 is changed to:

"No one with criminal conviction or ongoing court hearing shall be a juror."

 

The following articles are added:

"14.20 No one with criminal conviction or ongoing court hearing shall be a delegate."

"15.20 No one with criminal conviction or ongoing court hearing shall be a delegate."

Article 6.7a is changed to:

"Common, collective and equal ownership and control of all productive and other economic resources by all the members of the society".

Article 10.3d is added in Section 10. Family and Kinship.

"Persons in close kinship shall not be elected or appointed to, or serve as officials in, any public service if their kinship relations can create conflict of interests or jeopardise their public function or their integrity."
